The notice-and-takedown provisions, are, indeed, perhaps not as
pure-evil as the anto-circumvention provisions. But, still, they are far
from ideal.
A better solution would be to grant ISPs "common-carrier" status, so
that they are not liable for the information that flows across their
wires. Telephone companies have this, and the world has not come to an
end as a result.
